1. Purpose and scope
These general terms and conditions of sale (hereinafter referred to as “T”) govern the contractual relations between Akyras (hereinafter referred to as “Akyras”) and any natural or legal person (hereinafter referred to as “the Client”) using the services offered on the akyras.fr website.
Any order or use of a service implies full and complete acceptance of these T
2. Description of Services
Akyras offers a SaaS business management solution based on the Dolibarr ERP, enriched with specific modules (“Akyras overlay”), including:
- Management of quotes, invoices and electronic invoicing (in accordance with the 2026/2027 reform).
- Management of customers, products, stocks and cash.
- Integrations (bank sync via GoCardless, online payments via Stripe/PayPal).
- Secure multi-site hosting with automated backups.
- Access to customer support.
The services are available in several offers:
- Akyras Discovery (free for a period of 1 year).
- Paid offers: Essential, Pro, Premium, described on the akyras.fr website.
3. Account creation and obligations of the Client
- The Client must create a nominative account to access the Services.
- It undertakes to provide accurate, complete and up-to-date information.
- The Client is solely responsible for the confidentiality of his/her identifiers and the use of his/her account.
- Any fraudulent or non-compliant use may result in the immediate suspension of the Services.
4. Rates, invoicing and payment
- The prices in force are those displayed on the akyras.fr website, expressed in euros, excluding VAT.
- Payments are made via the secure service providers Stripe (credit card) and PayPal.
- Akyras does not store any bank data.
- Bank sync (via GoCardless) is not a payment method, but only a bank reconciliation tool.
- Subscriptions are monthly or annual, with automatic renewal until canceled.
5. Term, Suspension and Termination
- The contract is concluded for the period chosen by the Client (monthly or annual) and tacitly renewed.
- The Client may cancel at any time via their customer area or by email (contact@akyras.fr).
- In the event of a serious breach of the Client’s obligations (e.g. fraud, non-payment), Akyras reserves the right to suspend or terminate the account.
- The Client’s data is rendered on request in a standard format (CSV, SQL dump).
6. Intellectual property
- The software, modules, interfaces, logos, texts and content offered by Akyras remain the exclusive property of Akyras.
- The Client retains ownership of its hosted data and content.
- Any unauthorized reproduction, distribution or use of Akyras elements is prohibited.
7. Availability, security and maintenance
- Akyras implements all reasonable means to ensure the availability and security of the Services.
- The infrastructure is hosted in the European Union, with data partitioning, encryption and regular backups.
- Temporary interruptions may occur for maintenance.
- Akyras cannot be held responsible for interruptions related to third parties (hosting providers, payment providers).
8. Liability and Limitations
- Akyras cannot be held liable for indirect damage (loss of data not saved by the Client, loss of turnover).
- Akyras’ liability is in any case limited to the amount paid by the Client in the last 12 months.
9. Protection of personal data
Akyras is committed to complying with the regulations in force (GDPR). The processing carried out in the context of the Services is detailed in the Privacy Policy accessible on the website.
10. Force majeure
Akyras cannot be held liable in the event of force majeure within the meaning of Article 1218 of the Civil Code (generalized Internet outage, natural disaster, massive cyberattack, etc.).
11. Applicable law and disputes
These T are subject to French law.
Any dispute will be submitted to the competent courts within the jurisdiction of Akyras’ registered office, after prior attempt at amicable mediation.
